General Terms and Conditions
Scope of application
The
GTC regulate the legal relationship between Bioweingut Rebhalde, owner Sven Hohl, Hintere Püntacherstrasse 25, 8712 Stäfa and its customers with regard to all contracts concluded between the parties. Any provisions of the buyer that conflict with these
GTC are hereby expressly excluded.
Offer
The offer of Bioweingut Rebhalde is available on the website
www.weingutrebhalde.ch and is non-binding. Prices and assortment as well as technical changes remain reserved. The product offers are only valid while stocks last. Product information such as content details, images, etc. are mainly for illustrative purposes and are not binding.
Conclusion of contract
On
www.weingutrebhalde.ch, the buyer submits a legally binding offer to conclude a contract by sending his order and simultaneous acceptance of these terms and conditions. The contract is concluded at the time when the buyer receives an order confirmation by e-mail from Bioweingut Rebhalde. Confirmed orders can no longer be cancelled or changed by the customer.
Delivery area & delivery conditions
The Bioweingut Rebhalde restricts deliveries to the territory of Switzerland and the Principality of Liechtenstein. Delivery is made directly to the delivery address and
contact person provided by the customer. Provided that the goods are in stock, delivery is usually made on weekdays within 7 days.
If orders cannot be executed for any reason, the customer will be informed immediately and any payments already made will be refunded.
Prices & delivery costs
All prices are in Swiss Francs (CHF) including VAT. Prices, conditions and vintages stated on the website are subject to change, the effective date being the date of the order. The delivery or shipping costs are to be paid by the customer and are calculated as follows.
1 to 6 bottles CHF 15.00, 7 to 12 bottles CHF 20.00, 13 to 24 bottles CHF 30.00.
From 25 bottles or a value of goods of CHF 400.00 free of charge.
Payments
In principle, the goods are sent together with the invoice. This is payable net within 30 days. The delivered goods remain the property of the seller until full payment. Unauthorized deductions will be charged subsequently. If the customer defaults on payment of the purchase price, the seller is entitled to take possession of the goods. (declaration of withdrawal). Bioweingut Rebhalde reserves the right to execute first orders only against advance payment.
In case of sale ex farm, you can also pay yours in cash, with Postcard, EC-Direct or Twint.
Redemption & Liability
The buyer must report obvious defects by e-mail to
info@weingutrebhalde.ch no later than 5 days after receipt of the delivery. Hidden defects must be reported immediately, but no later than 5 days after discovery by e-mail. If the buyer fails to report the defect in time, his warranty claims will expire. The defective goods must be returned with a copy of the invoice and a detailed description of the defect. The transport costs incurred shall be borne by the buyer. In the case of warranty, the seller decides whether to reduce the purchase price, replace the goods or refund the purchase price. Excluded from the warranty are damages for which the buyer is solely responsible, e.g. as a result of improper handling, incorrect storage or external influences for which the seller is not responsible. Products ordered by the customer by mistake will not be taken back or refunded.
Sale of alcoholic beverages to young people
In Switzerland, the sale of alcohol to young people is regulated by the Foodstuffs and Consumer Goods Ordinance (Lebensmittel- und Gebrauchsgegenständeverordnung, LGV) of November 23, 2005, and the Federal Law on Distilled Waters (Alcohol Law, AlkG) of June 21, 1932. The law prohibits the sale of
wine, beer and cider to under 16-year-olds and the sale of
spirits, aperitifs and alcopops to under 18-year-olds. By accepting the terms and conditions and sending his order, the buyer confirms that he is at least 18 years old, and therefore this regulation can be respected.
Changes
The present General Terms and Conditions (
GTC) can be adapted to the circumstances at any time.
